if that were the case, yes. But we are talking about manslaughter. 25yr minimum for manslaughter is ridiculous. Intent is everything. Now civil lawsuits are another kettle of fish and results are more important than intent. They may be killers, but they are not murderers.
I suppose it comes down to one's views on mens rea and how it relates to deaths similar to what we are discussing. My opinion is if people are able to logically understand the risk of killing someone by driving drunk,high, or while texting; and if they are intentionally participating in an action that they could foresee a side-effect such as a death; that they are knowledgeable and willing to the point they should also accept full criminal responsibility.
