Anyone here ever had to deal with extensive damage caused by a transporter? If yes, to what extent and how easily was it resolved?
    Did you have to sue?
    Did they pay diminished value?

    Wade,

If you use Intercity, you should not have this problem.

If you used another and have this problem, it's not an easy process. The only way you can effectively sue them is in their home place of business, because there may be no way to verify the damage occured where you are and that, therefore, that should be the venue for litigation.

If you sue them where you are, you would would have to do so in the Federal Court for your district, and that will get expensive, and your damages for Federal Court have to exceed $50,000.00!

Furthermore diminished value is a very difficult damage to prove in court.

Don't want to complicate your matter, just imparting the law.

I have made the mistake of using non-Intercity transporters, with disastrous results. Next time, even for a non-exotic, I'm picking Intercity again, if for no other reason than I know it will show up on time as well as undamaged. They have a perfect track record with me.
    On the other hand...

    Thanks guys,

Fortunately the shippers base of operations is about 15 miles from mine. So that is not an issue. I also beleive the damage will exceed 50k. It is all docuemted both in writing and photo. They have admitted to the fault. I am waiting to here from their insurance.

Just trying to get ahead of them with as much info as possible.

I am worried about diminished value though

    Wade,

I wouldn't worry until you have to. Their insurance company should come through. With $50k + damage, I have to ask what happened?

Good luck and keep us posted......

    Wade, I understand.........

I wasn't going to bring this thread up. This is clearly a worse case and Wade said they have admitted guilt.

I didn't mean to freak Wade out, but that thread does touch on every single question Wade posed in his original post.

I read through that entire post and can't believe that has been going on over a year. I sure hope this does not go that route.

"They have admitted to the fault"

Have you got that in writing from them?

    Have you defined "fault"?

Make sure you do for proper recovery.

Also, if they are local to you, Federal Court System will not apply.

I would also suggest you search your Secretary of State's web site to make certain they are domiciled in your state.

I've done about 10 long distance purchases and deliveries to people who've purchased cars from me and have used three other sources - none of them being intercity - why - because they failed to keep their promise about pick up. I've used Goldrush (NC), Passport/FedEx (Missouri) and Thomas Sunday (PA) for all my Porsche and Ferrari deliveries without a single incident. Prompt, courteous, professional - each and every one of them. Your mileage may vary, just thought I'd give another perspective and to let you know there are other very reputable folks in this business

Glad to hear good things about Fedex/Passport. They will be delivering my Porsche C2S, I contacted Intercity and was told they did not currently service my area. Florida to St Louis.

If anyone's interested.. I've used Exotic Car Transport out of Orlando,
    www.exoticcartransport.com and
Precious Metals Transport out of N.J. (201)954-5650

Both operations were curtious, ontime and fair with pricing. Drivers had no problem checking in to advise of traffic conditions or coordinate dropoff times etc..

    Best of all..No Damage!!

I agree, Exotic is my new favorite and I've used pretty much all of them. They bent over backwords to do a pick up for me during the week of Barrett Jackson. Everybody else was quoting 3 weeks +.
