    Several months ago, I posted about my on going battle with Allstate Insurance. This all began back on Feb. 19, 2004, when a lady talking on her cell phone hit me from behind while I was stopped waiting at a red light. I finally settled my claim on about August 20, after a long battle. I would like to give some valuable insight to others who may end up in my situation. #1 -if you are in an accident that is definitely not your fault, when asked if you are injured, if you are not, don't say no. I am not saying you need to lie - just simply state, "I feel like my condition needs to be evaluated by a doctor." (I did not do this, but I definitely will in the future- you never know what might be injured that will show up months from then) #2 Anytime you talk to the adjuster by phone, inform them you are recording the conversation, and do so #3 persistence pays off - I have had a long career of tough business negotiations, but I will have to say dealing with Allstate was tougher than any business negotiation I have ever had to deal with. With my previous post concerning my accident of "FerrariChat", several members made suggestions that really helped, along with friends of mine who are attorneys and in the insurance business. If an insurance company offers you a settlement that seems unfair, don't take it! #4 If the settlement seems unrfair, and they won't budge, most states have a state insurance commissoner. Their powers vary from state to state, but I found insurance companies don't like for you to complain to them. In the State of Tennessee, the Insurance Commisioner can't really make them do anything, but in my case, a suggestion to Allstate that they "re-address" the matter brought instant action and $2000 more to their last offer. #5 Once you make a claim to the State Insurance Commissioner, they mail you a copy, and it is not to the local adjuster then, but the state director of adjusters for the insurance company with which you are dealing. Any future correspondence you have should be sent directly to him (or her) by certified mail with return reciept. #6 If you still don't think the offer they make is fair, make a detailed report of everything so far, and mail it to the consumer watchdogs at your local TV station. Of course, send a copy to the insurance companies State Claims Director.
    I learned a lot, and I hope there is not a "next time," but in the event there is, I will be much better prepared.
    My problem now is some of the collector and speciality insurance companies will no longer insure me because I now "don't have a clean driving record" because some idiot talking on their cell phone rear - ended me.
    I know this post is lenghty, and I apologize for that. I would like to thank everyone who replied to my post - I sincerely appreciate everyone's input!

    sorry to read about your accident. thank you for taking the time to share the info with us from start to finish. i dont see how Hagerty or the " other" classic car insurers can deny you if the accident was not your fault. i was rearended by a saturn , while driving my jeep several years back. it took about 3 days for me to feel sore and go to a doctor. just visiting a doctor made the other parties insurance want to settle. glad you were not hurt, we love our ferrari's but ones health is MUCH more important. :)

    lesson learned:

    insurance companies are out to collect premiums not to pay claims!

    They will try to screw you any which way they can. This week I am taking one on myself. We will file suit by the end of the week. No worries. I love that sh@t.

    Will also file against UPS Insurance who lost a wheel I had sent to a customer (one of 4). They said since the customer did not hold the package (one month after the delivery and the initial claim) they are not responsible.
    We'll see about that when they have to spend a few thousand in lawyers to come to court.

    Just won a case against Waste Management, where one of their trucks spilled rocks on the road hitting my windshield cracking it. $1200 damage. They did not see it fit to give me their insurance company to file my claim direct and did not show for court, judgement for the plaintiff. Now I told them if they don't pay I will get the wit of execution and show up there with the Sheriff and pick up one of their trucks as collateral for the judgement. We'll see.

    As I said. You have to stand up for your right and be able and willing to fight!

    Thanks for the heads up. Any time an insurance claim comes up it is a headache. Education is the key to lessening the pain of dealing with it.

    I have had to turn to the old insurance commisioner more then a few times. Which reminds my of something I would like to share with the Fchat Community

    ALL INSURANCE COMPANIES LIE

    I said LIE. That's L-I-E for anyone who may misunderstand exactly what I am trying to say here. One more time... LIE!!!

    I deal with them 8-5, Mon thru Fri. and I will be happy to tell anyone who would care to disagree with me as many stories as they would like to hear to support my statement that all insurance companies LIE. All I ask is that you call me as I cannot type fast enough just to scratch the surface. I am in the book. Best time is 1-2 cst. Bring it on.

    I agree with the Doc, as I deal with them on a daily basis. They have to be one of the crookedest professions out there. They all LIE.

    Is there a reason why Insurance companies like to screw their own customers over? Glad to hear you weren't injured in the accident and this stressful fight of yours is finally over.

    I followed your original thread with some interest as everything I have is insured with Allstate except my 308. Glad to hear you were able to finally get them to settle (hopefully it was on your terms!!)
