What good is a DA anyway (The mechanic wins)

    Here's the story:

    A mechanic bounces a check to a customer for $5,000.00. The customer files a police report. The police draft a iron-clad case and sent it to the DA for prosecution. The DA round-files the case stating 'not enough evidence'. JESUS! This case is SO friggen black and white it's not even funny. Why are taxpayers funding a DA that would tell a customer who got stung with a bad check for five grand to go screw himself? This aint mice nuts!

    I don't know, ask your governor or county representative........ Can't they take a second look at it? If not, I'm sorry.... grab a beer and relax. It is amazing what happens in the court systems.

    In some states, if you write a bad check, you are taken off to jail pretty quickly. It's sad to see this one fall through the proper loops.

    Go to the county Board of Supervisors and complain publicly; that might get their attention if an assistant DA is not doing their job.

    call/email your local news as they might have one of those "undercover" investigator types to sniff it out. That'll get the DA's attention.

    Pete, is this "customer" you...? i thought you had this thing all wrapped up...? If this is still about you, then this is ridiculous, you need to go over there and string this guy up by his balls...

    Have you spoken with the DA? These are political people, and are often more concerned with how many convictions for the "public outcry crime of the moment" rather than going after real justice. I would call him up and ask what the problem is, and what "evidence" he suggests would be necessary?

    Let him know you are absolutely serious about this, and intend to follow it to it's full potential, including getting as much media involvement as you can. Don't threaten, but let him know his just saying "won't prosecute" will NOT be the end of it.

    If you continue to get no satisfaction, trying contacting those consumer protection shows where they investigate injustices against folks like yourself. The unwillingness of a government official to help you, even after the police have done all the ground work and you are ready and willing to help will be a tasty morsel for them. Those guys love nothing more than government expose' type features, and the little guy getting screwed + politicians unwilling to help and do their job is the kind of stuff they die for.

    If you pursue this enough, I'm betting you will get satisfaction one way or another.

    Why's the mechanic writing a check to the customer? Anyway, there has to be another way. Does this guy have to be bonded? Post a claim on his bond or make a huge fuss at his place of work until the guy coughs up. Get creative!

    I've seen the Worthless Check Division of our DA's office go after people for $50 bad checks.

    I would go talk to them. I remember when this came up before. I can't believe it is still going on.

    Civil court may be your last option if the DA's office does nothing to get your money to you.

    I have a call into the DA. I expect a return call tomorrow. I WILL NOT take his decision laying down. If I get a poor response, I will post his name and phone number for all to call (and voice your opinion). In parallel, I sent my story to the Exec Editor of the Tri Valley Herald.

    I'm surprised DA didn't take time to explain to you yet. They must value $5,000 less than I value. First of all, I was also amazed mechanic's check to reimburse you wasn't made by money order or cashier's check.

    no surprise really dif country but my little bro got robbed like $800 worth of stuff the guy got caught and charged he makes $300 a week after all expenses (tax, rent, food, debts etc) and only has to pay back $10 a week
