    so now you're a lawyer?

sadly you're wrong about the truth not being a defence...who told you that rubbish?

indeed it is! esp the bit where i show the pics of the oil leaks, where you admit there was an oil leak in a spot that you'd already attempted to fix, where you admit you didn't want to fix it cos you didn't like me, and where you admit you handled the whole thing badly.

yep.....it's all in there....and in all this time, try as you might, you've never been able to disprove ONE word i've said....why? cos i'm the one with the proof. every word i've said? all true.

    p.s. just SAYING i'm a liar doesn't make me one...but keep trying.

the leak was fixed at first attempt... it came back after some time. (wrong silicone used)

your complaint stemmed from the sump leak forming puddles in your floor panel and then occasionally spilling out... you merely noticed the smaller leak from the cam covers and assumed it was ALL from there...

And you saying I'm a liar doesn't make it true...

bringing this up all the time only shows what crap backup service you give. the leak was noticed within 3 weeks of you doing it. whether it was the silicone or not is hardly my problem. just what you write in the above sentence is enough to prove that you "fixed" it, but it still leaked...can you not see that?

well...no, it didn't......but even if it did, so what? your second para AGAIN confirms that there was a leak from the cam covers that i'd already paid you to fix.

no...i don't need to say anything...i just leave it to you.

so...what do we end up with here? your first two paras admit that i had an oil leak from my cam covers after i paid you to fix them...(whether it's because you're a crap mechanic or because of the silicone, i'm not qualified to answer)

So, was that a problem in itself? no...the fact that it took you 13 months to finally fix it properly...that's the problem! and yes...i still have the emails to prove it.

    you're funny

It won't hold up in a defamation case. I could be a goat molesting Kelptomaniac and you could go and tell the world that. But if I can prove that you defamed me by doing this (in other words a commercail loss) then your toast.

Go and dig through what Alan Jones has been spending all of Southern Cross' money on over the years.

Truth (and its close relative, justification) are definitely valid defences in defamation actions. However, they may not provide a 'complete' defence in all circumstances (I think this is what you're referring to). If truth and justification weren't available as defences, the media would be prevented from reporting much of what constitutes 'news'. Also note that with defamation, a plaintiff need not show any loss (c.f. other torts); the tort/injury occurs purely by the fact that what has been published has defamatory meaning in relation to the plaintiff.

and that, dear boy, is why you're barking up the wrong tree...not only is everything i said the truth, FFace has said in this forum that he's got more business than he can handle, partially because of me, and said, facetiously, that maybe he should have put me on commission.

i hope that clears it up for you.

Yeah, shot myself in the foot there, didn't I.

Of course, someone such as yourself would have muchmore first hand experience with the law than little ole me.

Would one not just have to show the truth was in the public interest, regardless of how defamatory it was?

Public interest, honest opinion, etc all fall under justification, and the media also relies on qualified privilege in some circumstrances.
