In a highly related tangent: my girlfriend is a teacher, and she is not allowed to fail students without the expressed written consent on their parent(s). If they do not agree, the student is given a minimum passing grade and moved on to the next grade. Be very afraid my friends.

The would of/should of/could of error has been an issue for several years now and it is clearly getting worse. Almost as annoying as the absolutely incredible misuse and abuse of our humble friend the apostrophe.
I suspect that some of the parents of said failing children lack the ability to provide expressed written consent, even if the desire is present.
