Obscene speech is unprotected. Many small towns have passes legislation making it illegal to use obscene language in public. I guess they list the words somewhere that they feel are obscene, I don't know. Other things are unprotected as well such as anything that could be considered "fighting words" or anything that is libel. I know there is a couple more but can't remember right now, its been a while since that class.
Should you change your location (in your profile) to DC? That IS where you are, correct? If you are, what you are saying is good news. I'm just stating my expriences that I'm certain do not happen every day. But, it does turn you off to future uses. Sorry, pal, again you are wrong. The big bad goverment of which you speak did not arbitrarily create a ban on sex toys. I'll bet that, if you were do do some *GASP*! research, you might find that the ban of sex toys is in existence as a result of voter wishes. Therefore, it is not the government that you should be angry towards, but the people of Arkansas or Alabama or whever the hell the law exists. But then again, you'd be mad if the government went against the wishes of the citiznes of the state, right? I'm not angry, nor am I looking for a fight. You post stupid ****, I call you on it. I'm only in DC for six weeks, then I go home. In fact, tomorrow will be my last day. I can't speak for every rider of the metro, but I haven't had any problems and haven't seen any, so perhaps it's gotten better since your last ride. Hopefully so.
Ummm....you need to take a civics course. I honestly can't beleive you don't understand how this works. Since you are so anti-education (and it shows with your lack of knowledge on the issue), I'll explain it. The state legislature creates a law, usually based on constituent desires. Someone who does not like the law challenges it. It goes to state court, and if it is upheld, the challenger can take it to federal circuit courts. If the federal courts uphold the state law, then it goes to the Supreme Court. If the supreme court upholds it, the challenger goes home. In this case, the sale of sex toys falls under a state's police powers (look it up - not what you think), which the state has control over (assuming it does not go against any of the rights stated in the constitution). The federal government does not have the power to override constitutionally sounds police power laws. Now, if someone can explain how banning the sale of sex toys is unconstituional, I'd like to hear how. Keep in mind that it is not illegal to use them, only to sell them in the state.
Ok, what am i missing here...? Aren't the aforementioned courts and police powers parts of the government, or did they come out of a Lucky Charms box...?
I recall one of our F-Chatters was thoroughly chastised for mouthing off to a cop when he was busted for being a bit inebriated as a passenger in a car. Laws exist in Metro stations. Some seem silly, but they're still laws. In Metro's case, it simply means no eating or drinking... or it'll cost you 10 bucks. Well, since government harrassment doesn't affect you directly, let's just ignore it and let it be somebody else's problem? The analogy to earlier mindsets which happened in the first half of the century is a little disturbing.
While I agree that arresting this person is pretty extreme, the DC Metro is pretty clear about no eating and drinking allowed in the stations or on the trains. The cars are carpeted, so anytime some schmuck spills their triple mocha latte or drops a candy bar in the middle of August, it gets pretty nasty. Her situation sucked, but she should have known better. The rule is no eating and drinking, so if you're gonna break the rule, be ready to deal with whatever ration of crap the metro police feel like dishing out on you and don't whine about it. I'm bothered more by her whining than by the cops' response. -R
