ZTL scam ?

    Hello people,

    Sorry for not posting this in Italian but I'm a fifth generation Australian with a very Italian name but very limited Italian.

    I went to Italy in 2019 travelling to Modena, Maranello, Firenze, etc in a hired car from Hertz and although I plotted all of the ZTL areas I fell into the Modena ZTL somehow.

    I received two (2) notices from Hertz over 6 months later stating that because I was to pay Euro113 for each offence.

    I paid these fines but never received a payment receipt and now FOUR years later I receive two letters in the mail from Avv. Guilia Brizzi saying that because I haven't paid the fines they are now Euro 271.40 each and payable to a website https://nlawyers.nivisecure.com using supplied username password in the letter.

    Alternatively I could do a bank transfer to :
    Beneficiary : NIVI Spa
    Bank : Intesa San Paulo - Filiale Peretola (FI)
    Iban : IT 87 W 03069 02995 1000000003437 Swift/Bic: BCITITMM
    Indicating a specific reference number

    I am having difficulty finding the payment I sent to the bank in Modena but I am wondering if this is a scam

    I had a problem years ago in Florence, paid it and no problem. Do you have a copy of how you paid? What can Hertz or the Modena police do to you?

    Thanks Dom, the bank account I paid the fine with was replaced in the divorce and I have no way of getting the information.

    It seems the Modena police have outsourced the fine to a lawyer who is writing threatening letters, I feel I have no other option than to pay the outrageous 272x2 Euro fines but thank you for replying

    My cousin asked was the ticket from the Vigili Urbani of Modena? Questions from me, did the lawyer cite the ticket numbers, and who issued them? As a banker friend of mine from Reggio Emilia said, he won't come after you, just forget it. Now if you have a conscience (like me), I would investigate it, and give him a reply. You paid it, so why not tell him that.

    Here is the thing, when a car is rented (that's what happened to me in Firenze), the ticketing agency doesn't send the ticket to you, they send it to the car owner, ie Hertz. Did Hertz bill you for it? If so, you can go back to Hertz and for sure they can show that you paid it.

    Hi Dom,

    The ticket was from the Polizia Municipale of Modena and yes the lawyer did cite the ticket numbers and who issued them.

    Hertz did not bill me they just passed my information onto the police

    I thank you kindly for looking into this for me, hopefully on my next trip to Italy I can buy you a nice drink for your efforts :)

    La polizia urbana non usa avvocati esterni , almeno così credo , ma fa rivalsa diretta.

    In english. The urban police don’t use external lawyers, as much as I know, and will contact you directly.

    Based on what you said, sounds legitimate. I live in the UK, let me know next time you are by. Dom

    Just a thought......the question really is: How did you pay them? Did you authorize an EFT payment from your bank account, pay by credit card or send them a check? Each one of those payment methods is easy to research even if the bank account or credit card is closed. Banks get these kind of requests all the time and usually for a nominal fee.....they will research and print what they have. Usually they will send you a reprint of your Statements for the requested months.

    Since you have a date range, what country it went to and the payment is less than 5 years old.....I would think the odds are in your favor.

    Its pretty much impossible to use a US check to pay an overseas bill, it had to be done by a bank transfer or a credit card. For sure, this person has a good chance to demonstrate he in good faith, paid the fine.

    Thanks Dom, it looked like a scam to me so I emailed the Modena police for clarification

    Thank your cousin for me and thanks for the translation, I may have an Italian name but am a fifth generation Australian.

    I am heading to the UK next year, would love to catch up and buy you a beer :)

    Hi JD, unfortunately my accounts I would have used were all pre-divorce and as such have been closed down and I moved onto new banks for personal and business.

    What I have asked the Modena infringement dept is to see if they could provide me with a receipt for the initial payment I sent

    Stupidly I should have asked for a receipt at the time but divorce has a powerful way of distracting you and getting a receipt was the least of my worries at the time but thanks for the input :)

    Good idea, I wonder how long it will take the Police to respond, if they do.

    Shoot me a message, I live south of Wolverhampton and north of Kidderminster. The burial site of Peter Collins is about 10 miles away, and I understand he didn't live all that far from me.

    Hey … just saw this. I had the same issue. ZTL fine when I rented a car from Avis in Modena in 2019.

    Fought it for a while, then things went quiet. Then, a couple of month ago, I got the same letter from Avv. Julia Brizzi. Tried accessing their web site, but it didn’t work at first. Sent them an abusive email and returnee access details. No reply so a few days later I rang them in Italy. Spoke to a human. New details were issued. In the end, I just paid it so my upcoming trip isn’t potentially disrupted. Would be nothing worse than stepping off the plane into handcuffs.

    It was a “legit” fine - I was definitely in the ZTL. It was just that my hotel stuffed up and forgot to arrange my parking permit.
