Doesn't seem like BS to me. If you're going to treat this for real, which is subject to question, then putting the pinks and cash into escrow seems like the thing to do. That's not changing the terms, that's making the terms real not bluff.

 

+1 It is simply locking both parties into the deal. It's the same as both of you making a bet and then handing the money to a good-buddy to hold before you do whatever it is you're betting about. Then if you loose you can't back out of paying. The buddy just hands over the money to the winner.
