NO payment!! What to do..?

    So, what do you think...you have TWO very reputable people that are on this board...they sell and buy cars as well as have collections for many many years.

    They both appear to have money..or at least they act like it..

    I have done several transactions with them for the past few years with out any issues..then with BOTH of them in the last two tranasctions..all has gone good with the exception of last payment of the last $5000.00 of a deal well over $200K each.

    The answer I get it, tomorrow tomorrow..I dont have the money today...I promise you the money..I owe it to you..I am just broke right now...this has been going on for about 2 months now..I am patient..but I have about had it..one even sent me a check that BOUNCED!!

    So, what do you think...should I call them out here and name them..or give them one last chance as I forward this posting to them both..?

    Forward the post to them privately-the threat of being called out in public (and following through) can be a stong motivator to suddenly find the necessary funds to complete a deal.

    Well, if you are going to "call them out" and state their names in a public venue, such as here on F-chat, I would hope (for your sake) that they also don't have enough money to hire an attorney :)

    The fact that what is stated being true protects you (once you've proven it true in a court of law) from most libel charges, but not from defamation of character / right to privacy (HIPAA) laws.

    The more appropriate, and quite effective, recourses at your disposal are small claims ($7,000 and under in most states) and "notice to cure / failure to pay" procedures.

    If they are bouncing checks, and paying by credit card, they are 'actiing' like they have money.

    As so many do.

    Nothing, directly. But, it has set in motion more stringent guidelines for all other privacy of information legislation. Publicly sharing information of someone's credit / financial / misc. personal info is a big "no-no" these days.

    I love starting posts that get everyone thinking and responding differently..I REALLY do learn stuff all the time..

    I guess I was just raised "old fashioned"..it sure aint about the little 5 grand..your right, it's about the "you said you would do it" so do it and live up to your end of the deal..so many frickn excuses and you just dont undersatnd the loyalty and honesty of people today..

    It sure seems like alot of them want to hide behind, "laws" privacy acts etc etc..till they ware you down and you give up...well I would rather spend bad money after good...espically if it is to get done "what is right is right"

    But all that starts good ends good..second is paid up, via credit card as well...guess this thread worked..

    OH and FYI, both signed Credit Card Authorization forms via fax and both charges went threw, so cant calim a back charge down the road,...

    FYI, this was over a year in the making

    Calling the last deadbeat out on here would be a violation of the law as it is personal information. Not worth the potential problems.

    Glad it worked out. Wish it didn't take so long. Should have been paid day one.

    I assume the 5k was for transportation or charges from another contractor? I think this because I would think you wouldn't transfer title until you had received full payment.

    In hindsight, I should not have parenthetically mentioned "HIPPA" ---- I did so only to draw attention to one example of the newer, increased level of personal privacy protection in the USA with which most of the public has become aware. Of course HIPPA only applies to the very specific type of data collected about an individual --- as it pertains to their medical status, history, and records. I did not intend to imply that reaches into this situation, only that we don't have the same general degree of freedom to openly discuss other's personal information as we used to have, here in the US.

    My background is not in the Law ----- I am just merely repeating what my Lawyer friends have said at our backyard barbeques....(and, yes, I am ashamed to admit that I have friends who are Attorneys :)).

    Also, I own several rental properties, and it is SIMPLY UNBELIEVABLE how much a landlord's hands are tied when it comes to discussing anything about a "dead-beat tenant's" failure to honor their contracted obligations. We are not even allowed to discuss / inform their prospective new landlords when they have used us as references!!!!

    Can you imagine?! A landlord no longer is allowed to inform another landlord that a particular individual has say, a history of late payment or was 3 months delinquent!! The only way to get such info is if legal actions were taken and court filings were recorded......

    I have had only one customer who owed me money that I was forced to act on. He told me that he was having a cash flow problem. I told him that I never buy anything that I can't pay for when due. Anyway, I just quit manufacturing stuff for them, it just wasn't worth it.

    I never loan money to a friend. I give them money because I would be to disappointed if they didn't pay it back. I feel your pain it really is about losing respect for the people you thought you knew.
