    Did you guys read the article in the latest issue of Sports Car Market about how the car owner got hit with a $2.9 million jury verdict for slandering a guy who had supposely did a bad job restoring his car? Never post complaints on a public forum unless you can prove 100% of what you say as true...like the guy in the closed post that claims a guy at Putnam Leasing is "big", "fat" and a "thief". As a lawyer I would sure take Putnam's case on a contigency fee!

    You mean he filed a suit for that amount, or actually got a judgment for $1M?

    Read the article, no surprise. When it comes to situations that go bad, and the potential of litigation looms, the best comment to make is, "no comment", then hire an attorney.

    There are usually three sides to every story, yours, theirs, and the truth.

    He may be? But, in a slander/libel suit ferrame better be able to prove he is big, fat AND a thief .

    Problem is that we're all in the mass media business now. When everything that was published was in a newspaper or book, there were (hopefully) talented copy editors looking it over and checking facts. The fact is that slander (verbal) and libel (print) have always been illegal. I am an editor and copy editor, and some of the things I read here make me cringe.

    Big companies are wary of using 'blogs and discussion forums like this one internally because any hothead can post anything.

    There have been a couple of threads recently, about Naples Motorsport and Putnam, that really didn't belong here. Both were a lot of hearsay.

    I know we don't need more lawsuits or lawyers, but libel is serious business and anyone who posts here or elsewhere needs to know that.

    I'm sure you'd feel different if someone had slandered your good name. I agree, however, that there are waaayyy too many vultures out there posing as attorney's taking advantage of the laws.

    I have a business and my name comes up on a board similar to this from time to time. So far, all has been positive or at least accurate. However, I deal with thousands of customers. If a screwball decides he hates me and posts lies that lead others to not buy from me, you bet I will be looking for the matter to be settled amicably with an apology. But, failing that, I will sue. This is about food on the table as well as honor. A lot is at stake when someone sets out to hurt a business. If you lost your job because some nut case libeled your employer, you might think differently.

    You have to pretext everything with "in my opinion" company such and such did a terrible job restoring my car. No one can sue you for expressing your opinion.

    Using the Putnam thread, the originator could have said things like:

    "in my opinion Putnam over charged me for returning my lease early"

    "in my opinion the customer service at Putnam was poor, as I felt the time laspe to return phones calls was excessive"

    "I feel that the $12,000 termination fee was excessive"

    "I feel that the person I dealt with at Putnam was not 100% forth coming in presenting the details of our transaction"

    And good luck to the guy collecting the 2.9 million, chances of that happening are zero.

    Not true. Speak your mind as long as it is factual, not embellished with metaphors, and does not include negative personal references. You can not call someone a thief, until that is proven in a court of law. You can describe the situation without emotion, but you can not publicly add your opinion since it has not been definetively proven.

    I am sure if the tables were turned and someone misunderstood your intentions, you would be pleased to have your reputation protected and be allowed to present your side before being crucified.
