At 11:50 p.m.!!! haha I finally got my new printer/scanner so I decided to share with you my "speeding ticket". I was driving home in the carpool lane after delivering some wood to my dad, I was probaly going about 80 before I saw the CHP. 80 was what I was going with a pack of cars, before the freeways split up and they went the other way. I saw him on lane 2 and slowed down to his pace, which was about 75. It was just me, him, and a couple of big rigs on the road. Then a few seconds later he slows down to about 65, I slowed down to about 70 and slowly passed him... which is where I messed up. Once I get ahead of him by a few car lengths he pulled me over. Our conversation went like this: Officer: "Why were you going 80 up behind me?" Me: (thinking aww damn he saw me) "uhh.. 80?... I was just going with the pace" Officer: "What do you do when you see a cop?" Me: "..Slow do.." Officer: "Slow down.. you passed me and I was going 70" Me: ".. uh.. yeah i was going about 70 something, with the pace" Officer: "I'm not the pace" Me Thinnking: aww crap He's mad I passed him. Power trip After doing some paperwork or whatever it is they do he comes back with a ticket. "Here's your citation, I only put 70 instead of 80... the speed limit is still 65" I was thinking.. WHAAAT.. 65?!! But didn't say anything Just as I was about to pull away he guns it right into where I was about to pull out to, cutting me off. Me and my sisters boyfriend (he was my passenger) were yelling WTF! What kinda sh*t is that! That made me want to fight the ticket when the court date comes around, BUT it's probaly not worth it because the court is about 2-3 hours away with traffic. I've passed CHPs on the freeway before, never had a problem... it seemed this one just had a power trip. Here's the ticket: Image Unavailable, Please Login
5' 10" and 135 lbs...dude eat a cheeseburger. It would probably be to your advantage to make the trip to court on this one. The officer had no radar evidence and unless his speedo was recently calibrated he stands on that flimsy evidence. Traffic citations will stain your insurance record for at least 2 years so you will have to swallow higher insurance premiums as well as the cost of the ticket. Do your best to get to court and good luck.
Andy - that sucks!!! Sorry that you got pinched, but tickets will happen when you drive. My last ticket was 3 years ago, in my jeep, when I was doing 75 in a 55 on I-95 in CT. I was in the middle lane keeping pace with all the other traffic. There were vehicles in the left lane passing me!! The cop just pulled up behind me and pulled me over. I happened to be the unlucky motorist on the road that day . Que sera sera... **** HAPPENS And insurance will hold this against you for 3 years!!! I was reminded of this ticket when I had to get a new insurance policy because I moved to another state.
Again, when you get pulled over, DO NOT say anything to the officer but "Either you are going to write me a citation or let me go". Don't give the officer anything to use against you in court! Take it up with the judge.
You admitted your mistake by saying you passed the police car. Never, ever, under any circumstances, pass a police car at ANY speed. I learned that lesson many years ago when an officer was nice enough to point out to me that my tags had expired. I'd advise against this strategy. Given this choice, the nice policeman will always choose to write you a ticket. It's best to stick with "yes, sir" and "no, sir" answers. Say as little as possible and absolutely do not try and explain away what they stopped you for, that's basically admitting you knew you were doing something wrong. If you want to argue the ticket, do it in court.

I was pulled over in 1990 for doing 26 in a 25 zone...and written up for 1 mph over the limit. This was in my parent's subdivision and residents were complaining to the local PD about excessive speeders in the sub. I was pulled over and was VERY polite to the officer I asked what I had done wrong and he told me that I was doing 26 in a 25 zone to which I burst out laughing and he then proceeded to cite me for 1 over. I took it to court to fight it and the ticket was "thrown out". (the officer did not bother to show up but I had to take a day off of school to go to court it was a real pain). Good luck again.
Get out of a ticket in three easy steps... at least in California. 1st Step: When you get pulled over... say no more than you need to. Cop: "Do you know why I pulled you over?" Me: "No Sir." Cop: "Well, do you know how fast you were going?" Me: "Yes Sir... I do." Or... "You ran a red light, made an illegal turn, yada yada yada." Me: "No Sir, I didn't." Now, assuming the court of jurisdiction for the ticket you're receiving is NOT the main county court, when the cop is handing you the ticket... you say... "Can you please change the venue to the Court at the County seat. It much closer to my home/office." This pisses cops off. But they are legally obligated to do it. They usually tell me... "Nope, sorry I already wrote the address." This is bulls**t. I refuse to sign the ticket until they do it. The point of this? Cop is much less likely to show up for court if he has to drive to the other end of the county for just one appearance. 2nd step: File a "Request for discovery" with the city and county district attorney. Forms are available from most online legal forum dealies. Request access to all information that will be used against you at trial. This is your Constitutional right. The beautiful thing... they will never, ever respond. I can imagine the laughs and chuckles these requests get when they are opened at the gov't offices. 3rd step: Show up for court. Assuming the cop even showed up, sit patiently and wait for your case to be called. When it is, politely notify the Commissioner of your discovery request and ask that the case be dismissed since the People have not provided discovery. Now... this will seriously piss him/her off. Stick to your guns, discovery is your constitutional right. Probably one of three things will happen. The Commissioner will dismiss the case, s/he will have the clerk reschedule the trial. If that happens, protest that your right to a speedy trial is being violated, or double jeopardy, or just tell him/her that you already took a day off work, it's grossly unfair to make you do it again when this isn't you fault. The best case scenario, and this happened to me once, is when the Commissioner allowed the hearing to continue, but didn't let the People present any information that wasn't provided in discovery. In other words, the cop had to stand there and, from memory (since he couldn't use notes) explain the violation. That was pretty funny... that cop probably had written 300 tickets between mine and when the hearing date was. He had no chance...
Speeding tickets suck. Lets say, you get pulled over at 12:00 am, for speeding and the cop rights the ticket 11:59 PM. Can you fight the ticket based on that?
Haha funny thing is that all I eat is junk food! I'm one of those that can't gain wait no matter what. Believe me i've tried. BTW it's probaly 130 lbs now... I just had food poisoning. I'm going to see if they let me take traffic school. If not, i'll consider fighting it in court. But it's about 2-3 hours away from where I live.
Don't sweat the ticket bro. I just got one on Christmas.. third ticket overall. 1) 17mph over in Dallas --> Defensive Driver in January 2) Failure to turn left on SAT day / Homecoming Night --> Deferred Jurisdiction (or something like that) 3) 47mph over a few miles from my house --> Court date coming up on the 25th. Both my speeding tickets have been in my moms car. Lexus's are too quiet!
If you pass a cop that is your azzz (with a big stick and some vaseline) !!!!! Police on the Highway are like the Interstate Pace car. Everyone is lined up 2,3,4 cars wide and as soon as he exits off its pedal to the metal and green flag racing again. Since the cop put on the ticket 70 in a 65 then all you will probably have to pay is the Court fee. No points will be deducted or no insurance hikes will take place since its under 10mph. I could be wrong but that is what has happened to me. If it would have been 10mph or more then a fine will probably be given and the insurance would be notified. I have had 3 tickets in 2005 (sucky year for me) doing, 84 in a 55, 92 in a 65 and 50 in a 35. Haven't had a ticket in almost 7 years until that fateful day when I was heading to the Tail of the dragon to meet up with a fellow f-chatter to cruise a few times with him in his Ferrari. All speeding tickets where reduced and I only had to pay 100 bucks at the clerk office. Insurance is still the same and no points are on my license. Lucky I guess !! I just keep it at a normal speed, possibly 5 mph over and let everyone else get the tickets.

you can also file a motion for a change of venue to the county court if that is closer to your home or office than the assigned couthouse, i will look up the exact cvc when i am not quite as inebriated
No, clerical errors can not void a ticket. Plus the officer could say that his clock said that it was 11:59. I had a friend who was given a ticket that had the wrong date on it and the judge told him this.
