What should I do here?!?! Chunk gone from my spoiler!

    Ok. The night before Thanksgiving I took the TR out to a friends house, coming home I turned into my neighborhood, and much to my surprise the pavement had all caved in! I scraped my front end good and took a little bit off of my front spolier. The place where the pavement caved is STILL not fixed, but just last week they put up barricades around it. What's my recourse here, can I go after the city, department of roads? Any ideas?

    Agreed, and while your at it sue the hell out of them . Say that the damage to your TR caused severe emotional problems.

    For you to recover anything from the city, you will have to prove negligence. Therefore, you will have to prove that they knew about the pothole and failed to repair it in a reasonable and timely manner, or barricades or other warnings were not put up.

    So, if you cannot document that the city knew about the pot hole between the time it "appeared" and the time you drove home, and they had a reasonable amount of time to block it off, then you are SOL.

    The city or town doesn't know about a pothole or other road defect until someone sees it and reports it to the proper department. Did you call them and notify them after you damaged your TR? If you didn't, and they weren't notified until yesterday (or whenever they put up the barricades), then there was possible other people that suffered damage that could have been prevented by your call. That obviously goes for all of your neighbors too, as they obviously have driven in/over/around it over the last 2 weeks. Food for thought. It's easy in today's society to assume someone else will make the call. We have all been guilty of it at some time, I'm sure.

    Good luck with the repair. I hope it isn't too costly.

    Were there barricades around it at the time of the incident?

    Is there another way home?

    If there is,
    "Barricades? What barricades?"
    OR
    "I thought it was fixed."

    If you claim ignorance - stick to your story. If you thought it was fixed because there were no barricades, City can say it must've been vandals who took barricades down, thereby making it not the city's problem.

    After driving sports cars w/ less than 5 inches ground clearance for the last 20 years I’ve gotten used to this kind of damage. Have never been successful in getting the city to pay for anything. Allstate has been good to me.

    Capone - You should also look into just paying cash out of pocket for this, rather than involving insurance. As for your claim against the city, go for it! But I doubt you'll get anything after all the red tape and bs.
    How bad is your spoiler? I hit a raccoon while driving my TR, and that took a 6" long x 3" high chunk out of my front spoiler on the passenger side. Cost me $1500 cash to get it fixed.

    Hey,
    The front spoiler on my Mondial was damaged beyond belief. My shop removed it, rebuilt it and beefed it up with additional fiberglass. Proper sanding and painting, and it was as good, yet much stronger, than new! It's not a big deal.
